NO PURCHASE OR SUBMISSION TO SALES PRESENTATION NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW. PLEASE READ THESE RULES CAREFULLY. AS EXPLAINED BELOW, THE RULES REQUIRE THAT DISPUTES ARISING OUT OF OR RELATING TO THIS SWEEPSTAKES BE RESOLVED IN ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN BY CLASS ACTIONS OR JURY TRIALS, AND LIMIT YOUR RIGHTS AND REMEDIES IN THE BYB OF A DISPUTE.
Sweepstakes Period: You may enter the BYB Merchandise Sweepstakes (“Sweepstakes”) beginning 12:00AM BST on October 14, 2022 through 6:00PM BST on October 16, 2022 (“Sweepstakes Period”). All interpretations of these Official Rules and decisions made by BYB relating to the Sweepstakes are final. The Administrator’s computer is the official timekeeping device for this Sweepstakes.
Who May Enter: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, and legal residents of the United Kingdom (“U.K.”) who are at least eighteen (18) years or older. Employees, officers, directors and assigns of BYB Extreme Fighting Series, LLC (“BYB”), and its respective parents, affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising, and promotion agencies, and any and all other companies associated with the design or execution of this Sweepstakes (collectively, “Released Parties”), and the members of the immediate families (spouse, parent, sibling and child and their respective spouses, regardless of where they reside) or households of any of the above, whether or not related, are not eligible to enter or win. Void where prohibited. Sweepstakes is subject to all applicable federal, state and local laws.
By participating in this Sweepstakes, entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by BYB and by the decisions of BYB; (b) acknowledge compliance with these Official Rules; (c) represent and warrant that he or she meets all the eligibility criteria set forth in these Official Rules; (d) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (e) agree to release and hold harmless the Released Parties and their respective parents, subsidiaries, affiliates, agents, officers, directors and employees from and against any and all claims, injury or damages arising out of or relating to participation in Sweepstakes and/or the use, misuse or redemption of the prizes (described below), and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related or other cause of action.
How to Enter:
Online Entry Form: During the Sweepstakes Period visit www.bybextreme.com (the “Website”) and subscribe to the Newsletter (the “Newsletter”) to complete the online entry form to receive one (1) entry in the Sweepstakes. Online entries must be received between 12:00AM BST on October 14, 2022 through 6:00PM BST on October 16, 2022 for valid entry. If you submit your entry via your wireless phone, message and data rates may apply. Please consult your wireless-service provider regarding its message and data pricing plans.
All information submitted by entrants is subject to and will be treated in a manner consistent with BYB’s Privacy Policy. By participating in the Sweepstakes, entrants hereby agree that they have read and accepted BYB’s Privacy Policy and agree that BYB may collect and use their personal information in compliance with BYB’s Privacy Policy.
There is a limit of one (1) entry per person per method per day. A “day” is understood to mean between 12:00am ET and 11:59pm ET. Entries received from any person or email address in excess of the above stated limitation will be void. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the Official Rules, as determined within BYB’s sole discretion. If you use fraudulent methods or otherwise attempt to circumvent the Official Rules, your entry may be removed from eligibility at the sole discretion of BYB. BYB has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to, the use of bots, macros or scripts or other technical means for entering. In the BYB of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized email account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
Random Drawing & Odds of Winning: Five (5) Prize winners will be selected by Administrator in a random drawing on or about October 16, 2022 from all eligible entries received and combined throughout the Sweepstakes Period. Odds of winning a prize depend on the number of eligible entries received and combined throughout the Sweepstakes Period.
Winner Notification: The potential winners will be notified by phone and/or e-mail and will be required to confirm his/her name, address and phone number or email address, as the case may be, within twenty-four (24) hours from when the phone call is made or email is sent, as the case may be. If a potential winner does not confirm his/her contact information as requested within the twenty-four (24) hour time period then, time permitting in BYB’s sole discretion, an alternate potential winner may be selected in a random drawing from among all remaining eligible entries received. If the potential winner cannot be reached directly within twenty-four (24) hours from when the phone call is made or email is sent and/or does not meet the eligibility requirements, the potential winner will be disqualified and, time permitting in BYB’s sole discretion, an alternate potential winner may be selected in a random drawing from among all remaining eligible entries received. The potential winner will be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within two (2) days of date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, BYB is unable to contact the potential winner or the potential winner is not in compliance with these Official Rules, the prize will be forfeited and, at BYB’s sole discretion, an alternate winner may be selected for the applicable prize from among the remaining eligible entries received during the Sweepstakes Period.
Prize: Five (5) Prize winners shall receive an Official BYB 12 London Brawl Event t-shirt (the “Prize”). Winner must abide by all BYB policies. BYB reserves the right to revoke full or partial prize from the winner who it or BYB personnel deem may, in its sole discretion, have violated any BYB policy or law, or may bring BYB into disrepute.
Approximate Retail Value (“ARV”) of Grand Prize: $25.00 USD. Any difference between stated value and actual value will not be awarded. The Grand Prize must be taken on dates specified by BYB or prize will be forfeited and BYB will have no further obligation to such winner. The Grand Prize winner must respond promptly to BYB’s request regarding connection with the Prize. The Prize winner agrees to comply with all BYB rules and regulations.
Prize Conditions: All costs and expenses related to acceptance of any prize in this Sweepstakes not specified herein as being awarded shall be the sole responsibility of the winner, including, but not limited to, all federal, state and local taxes incurred by the Grand Prize winner. Prizes are non-transferable and no cash redemption or prize substitution allowed, except at BYB’s sole discretion or as provided herein. BYB reserves the right to substitute any prize with one of comparable or greater value, at its sole discretion. The dates for fulfillment of the prizes are subject to change in BYB’s sole discretion. BYB reserves the right to modify the Sweepstakes in its sole discretion and award a substitute prize, or portion of prize, of comparable or greater value as set forth in these Official Rules.
PRIZES ARE PROVIDED “AS IS”. ENTRANTS ACKNOWLEDGE THAT RELEASED PARTIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES AND ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Prizes pictured in online, television, print advertising, and other Sweepstakes materials are for illustrative purposes only. Arrangements for the fulfillment of the prizes, including all travel arrangements, will be made by BYB.
Taxes: The winner must supply BYB with a complete and valid IRS Form W-9 prior to receiving a prize. The value of a prize is taxable to the winner as income. An IRS Form 1099 will be issued in the name of the winner for the actual value of the prize awarded if the aggregate value of the prize awarded to and other compensation received by the winner from BYB is $600 or greater for the calendar year. All federal, state and local taxes, and any other costs and expenses associated with acceptance and/or use of the prize not specifically provided for in these Official Rules are solely the winner’s responsibility.
Publicity Release: By participating in Sweepstakes, the winner (i) by acceptance of a prize, except where legally prohibited, grants permission for BYB and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for commercial, advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval and (ii) grants the right to BYB, and its representatives, affiliates, licensees and assigns, to record, film, videotape and photograph the winner (“Images”). These Images will be owned by BYB. BYB and each of its designees shall have the right to use, re-use, reproduce, publish, display, exhibit, distribute, edit, adapt, post, stream, copy and exploit such Images, and all elements embodied therein, including any names, likenesses, address, voice, conversation, biographical and prize information and any other attributes of the applicable winner, individually or with others, in whole or in part, in conjunction with other material, if any, in any and all media now known or hereafter devised, for the purpose of commercial, trade, advertising, publicity, promotion, or a Sweepstakes winner list or any other lawful purpose whatsoever, in perpetuity, throughout the world, without additional compensation, consideration, notification or permission, except where prohibited by law.
Additional Rules & Restrictions: By participating in this Sweepstakes, participants agree to abide by and be bound by these Official Rules and the decisions of the BYB, which shall be final and binding in all matters relating to this Sweepstakes. If the winner is found to be in violation of any of these Official Rules, he/she will be required to forfeit the prize(s). Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, illegible or delayed entries, or prize claims; delays, failures, hardware failures, viruses, bugs, errors in programing; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize, Website failures, the cancellation or postponement of the BYB, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by Website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. BYB expressly reserves the right to delay the announcement of the winner for any reason BYB deems necessary. In addition, BYB reserves the right to select an alternate winner in the BYB that the potential winner fails to comply with these Official Rules or fails to execute any documentation requested by BYB within the time frame specified. By participating in Sweepstakes, the winner acknowledges that the Released Parties have not and will not obtain or provide insurance of any kind relating to the prize and that the winner will be responsible for obtaining and paying for any form of insurance relating to the prize that winner deem appropriate.
Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Website. Persons who tamper with or abuse any aspect of the Sweepstakes, Website or who are in violation of these Official Rules, as solely determined by BYB, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in BYB’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the BYB, corrupt or impair the administration, security, fairness or proper play, or submission of entries, BYB reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by BYB. Entrants, by participating, agree that Released Parties will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including any travel/activity related thereto) or participation in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, BYB WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
In the BYB of a termination of the Sweepstakes, a notice will be posted on the Website, and, in BYB’s sole discretion, prize(s) may be awarded to winner(s) to be selected in a random drawing from among all of the remaining uncorrupted applicable eligible entries received prior to any such BYB.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrants agree that (1) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, and not as a participant in any class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs directly attributable to participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or otherwise increased.
Choice Of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and BYB in connection with the Sweepstakes, shall be governed by and construed in accordance with the substantive laws of the State of Florida, USA.
Request For Official Rules and Winners’ Names: All requests for a copy of the Official Rules and for the name of the winner (first name and state only) must be made by October 13, 2022. Vermont residents may omit return postage if requesting a set of Official Rules. For the name of the winner and/or Official Rules: (i) send a self-addressed stamped envelope to: BYB Extreme Fighting Series, LLC, Attention: BYB Merchandise Sweepstakes, 7361 NW 35th St., Miami, FL 33122; and (ii) write, as applicable, “Winners List” or “Official Rules” on the lower left hand corner of the envelope.
Language: BYB, in its sole discretion, may reproduce these Official Rules in multiple languages. The English version of these Official Rules shall prevail and govern the Sweepstakes in all matters whatsoever.
